By accessing or using the site, you acknowledge that you have read, understood and agree to, without limitation or qualification, to be bound by these Terms & Conditions.

Returns Policy

As every A Note To Cherish is entirely custom made, we are unable to accept returns or exchanges.

However, if you have any issues with your order please let us know by contacting us via the form on our contact page or by emailing us at contactnotestocherish@gmail.com and we will be happy to help you.

Shipping

For countries outside of the UK, you may incur taxes, customs fees and other additional charges, and we are unable to determine how much these costs might be. For more information regarding the costs you may incur please contact the customs authority in your country or your local post office.

Please be aware that customers are responsible for any customs fees, import duties, or taxes which may apply. Notes To Cherish is not liable for any delays caused by customs clearance or any fees which may be imposed by customs in your country.

If customs fees are unpaid and your order is returned to us, any refunds will exclude postage costs and fees we may incur to receive the parcel. If we send a replacement piece to you in the event your order arrives damaged, we will cover the postage cost to send this replacement. If customs charges are applied to this parcel, the customer will need to pay these upfront, however once paid and the parcel is delivered, we will reimburse you for this fee once proof of the amount paid is provided to us.

In the event that you do not pay these fees and your parcel is returned, any refunds issued once your parcel is delivered back to us will exclude postage costs and any fees we may incur to receive this parcel.

Files you upload and submissions

In order for us to create your A Note To Cherish, you will provide us with photograph(s) as reference material either through this site or through other means of communication not limited to, emails and direct messages on social media. By providing us with these files you acknowledge and agree that they do not infringe any copyright, database right or trademarks of any person or company. By providing us with these files you confirm that the images are owned by you, and you consent to us using these across our social media for the purposes of promotion. Any content you post or upload to our site or submit to us will be considered non-confidential and non-proprietary and we have the right to use, copy, distribute and disclose to third parties any such content for any purpose.

Please be aware that any solicited or unsolicited enquiries, feedback, suggestions, postings, ideas or other information you provide us (collectively, "submissions") will be treated as non-proprietary and non-confidential. By transmitting or posting any submission to us, you hereby grant us a non-exclusive, royalty-free, perpetual, transferable, irrevocable and fully sub-licensable right to use, reproduce, modify, adapt, publish, sell, assign, translate, create derivative works from, distribute and display any submission in any form, media, or technology, whether now known or hereafter developed, alone or as part of other works. You also acknowledge that we may use your submissions and any ideas contained therein for any purpose including, without limitation, developing, manufacturing, distributing and marketing products. If you make a submission, you represent and warrant that you own or otherwise control the rights to your submission. You further represent and warrant that such submission does not constitute or contain software viruses, commercial solicitation, chain letters, mass mailings, or any form of "spam". You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead us as to the origin of any submission. You agree to indemnify us for all claims arising from, or in connection with your claims to any rights in any submission. 

Whenever you post content and upload files to our site you must comply with the provisions set out below: 

  • Is not indecent or obscene, does not contain any sexually explicit material and does not promote or refer to sexual activity.

  • Is not abusive, offensive, hateful, threatening or inflammatory, and is respectful of other people’s privacy.

  • Does not promote violence.

  • Is not used to impersonate anyone or to misrepresent identity or affiliation with any person or organisation.

  • Is not libellous or defamatory.

  • Does not promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.

  • Does not infringe any copyright, database right or trademarks of any person or company.

All information regarding the maximum embroidery size and our recommendations are clearly available on our website, please be aware of the limitations of stitch regarding what can be captured within the space available. If the pieces are long and/or contain intricate lettering some of this may not be captured in the final piece we send. By ordering you recognise and accept these limitations.

Intellectual Property

All content available on this site, including, but not limited to, text, graphics, logos, images and videos (collectively, the "content") is the property of us (Notes To Cherish) and is protected by copyright laws. Neither the content nor any other portion of this site may be used, reproduced, duplicated, copied, sold, resold, accessed, modified, or otherwise exploited, in whole or in part, for any purpose without our prior written consent.

Our site may provide links to websites or other online platforms operated by third parties. We are not responsible for the content on any of these sites. Please be aware that if you follow links to sites not affiliated or controlled by us, you should review their privacy and security policies and other terms and conditions. We are not responsible for the privacy or security of such sites, including the accuracy, completeness, or reliability of information.
